If I Live in Tennessee, What Are My Options for CBD?
CBD in Tennessee is legal to a certain degree. Here’s a little history on the topic and where the state currently stands:
- 2014: The state’s first CBD-focused law passes
In 2014, Tennessee's first CBD-focused law, SB 2531, was passed. It required that a hospital or a state university-affiliated clinic supervised the study of cannabis oil. To do this, the state needed marijuana to extract the CBD oil from. Tennessee Tech was designated as the institution that would cultivate marijuana.
Unfortunately, without authorization from federal law enforcement, the hospitals, clinics, and Tennessee Tech were unwilling to participate. That authorization was not granted, and therefore, not much happened.
- 2015: The law changes
In 2015, the legislature modified the law by passing SB 280. This new law allowed someone to possess cannabis oil in Tennessee if they 1) obtained it out of state, and 2) had a legal order or recommendation from the other state.
- 2016: The law loosens a little more
In 2016, the law was altered again to allow specific individuals to possess CBD oils with no more than 0.9% THC. Not just anyone falls under this umbrella, though. A person must have proof of the legal order or recommendation from the issuing state and proof that a Tennessee doctor has diagnosed them with seizures or epilepsy. The oils must be labeled, proving they comply with the laws of CBD in Tennessee and contain less than 0.9% THC.
- 2017: Bring in the hemp
In 2017, the legislature rolled out HB 1164, which adjusted Tennessee’s industrial hemp law to allow the production of hemp with less than 0.3% THC. Hemp growers must be licensed by the Department of Agriculture and procure their hemp in accordance with department rules.
What Legal Things Should I Know Before Taking the Plunge?
Overall, the laws of CBD in Tennessee are pretty straightforward. Make sure your CBD is hemp-derived and contains less than 0.3% THC. If it’s not hemp-derived, make sure your CBD contains less than 0.9% THC.
The biggest mistake you can make here is obtaining something with more THC than is legal in the state. If you possess a ½ ounce or less of marijuana, you’ve committed a misdemeanor resulting in a $250 fine and a year in jail.
