Tennessee CBD Laws

Nashville downtown scenery

Cannabidiol, better known as CBD, seems to have swept the nation. While CBD has largely grown in popularity over the past year or so, some states, such as Tennessee, were on board a few years prior. Care to learn some more about CBD in Tennessee?

What Is CBD?

If you’re not sure what CBD is, we suggest reading up on all the benefits you might be missing out on! In the meantime, we’ll give you a Sparknotes version.

CBD oil is a naturally occurring extract found in the cannabis plant. It is used in oils, edibles, and more. It should be noted that CBD can also be extracted from the hemp plant. In hemp, CBD is present in much higher percentages, and the THC that is found is very low — if present at all. It is important to remember that CBD will not get you high - that's THC.

What’s so Great About CBD?

CBD offers natural perks that nearly everyone can benefit from. What are they, exactly?

  • CBD relieves pain

When it comes down to it, there are two types of pain: musculoskeletal and nerve. Musculoskeletal pain affects - you guessed it - the muscles and bones, while nerve pain affects the nerves through pricking, burning, and tingling. CBD can tackle both.

  • CBD induces relaxation

Do you ever feel stressed out? Do you suffer from anxiety? Do you just need a little help relaxing? CBD settles the nervous system, creating a sense of calm in its users.

It’s probably safe to say many people do not get enough sleep. Do you? If you’re somebody that could use help falling asleep faster or staying asleep longer, CBD before bed might be the answer! Due to CBD’s ability to induce relaxation, a more restful sleep tends to follow.

  • CBD targets autoimmune disorders

Autoimmune diseases occur in people whose bodies attack their own tissues. CBD is known to reduce inflammation and helps balance the body’s immune system. Do you or does someone you know suffer from Chron’s, multiple sclerosis, or celiac disease? If so, CBD can help.

  • CBD and neurological conditions

When you hear about CBD in the news, it is often associated with epilepsy. Epilepsy is a neurological condition that causes seizures. CBD has been proven to lessen both the severity and frequency of seizures, which is the main reason why it is legal in so many places!

  • CBD calms your fur baby

That's right - CBD isn't just for humans! Your dog can benefit from the oil, as well. Got a pretty skittish pup from the pound who gets nervous when new people walk through the door? Consider a CBD treat to help calm your pooch!

If I Live in Tennessee, What Are My Options for CBD?

CBD in Tennessee is legal to a certain degree. Here’s a little history on the topic and where the state currently stands:

  • 2014: The state’s first CBD-focused law passes

In 2014, Tennessee's first CBD-focused law, SB 2531, was passed. It required that a hospital or a state university-affiliated clinic supervised the study of cannabis oil. To do this, the state needed marijuana to extract the CBD oil from. Tennessee Tech was designated as the institution that would cultivate marijuana.

Unfortunately, without authorization from federal law enforcement, the hospitals, clinics, and Tennessee Tech were unwilling to participate. That authorization was not granted, and therefore, not much happened.

  • 2015: The law changes

In 2015, the legislature modified the law by passing SB 280. This new law allowed someone to possess cannabis oil in Tennessee if they 1) obtained it out of state, and 2) had a legal order or recommendation from the other state.

  • 2016: The law loosens a little more

In 2016, the law was altered again to allow specific individuals to possess CBD oils with no more than 0.9% THC. Not just anyone falls under this umbrella, though. A person must have proof of the legal order or recommendation from the issuing state and proof that a Tennessee doctor has diagnosed them with seizures or epilepsy. The oils must be labeled, proving they comply with the laws of CBD in Tennessee and contain less than 0.9% THC.

  • 2017: Bring in the hemp

In 2017, the legislature rolled out HB 1164, which adjusted Tennessee’s industrial hemp law to allow the production of hemp with less than 0.3% THC. Hemp growers must be licensed by the Department of Agriculture and procure their hemp in accordance with department rules.

What Legal Things Should I Know Before Taking the Plunge?

Overall, the laws of CBD in Tennessee are pretty straightforward. Make sure your CBD is hemp-derived and contains less than 0.3% THC. If it’s not hemp-derived, make sure your CBD contains less than 0.9% THC.

The biggest mistake you can make here is obtaining something with more THC than is legal in the state. If you possess a ½ ounce or less of marijuana, you’ve committed a misdemeanor resulting in a $250 fine and a year in jail.

To help you avoid this, we’ve got some great solutions! Remember those benefits of CBD we talked about earlier, such as helping with pain and calming your pet? Here are our favorite hemp-derived products for each of those that are in line with what’s legal under the CBD Tennessee laws.

  • These capsules target pain, stress, sleep deprivation, and help with autoimmune and neurological disorders! They kill multiple birds with one easy-to-take stone, so it’s hard to imagine someone not liking them.
  • For your pup, these hemp-derived peanut butter treats are going to be a hit! He’ll gobble up these natural biscuits and will feel calmer in a matter of minutes.
