Is CBD Legal in Oregon?

The laws regarding CBD oil are very tricky.  There are federal regulations regarding all of the variations on cannabis, but the laws differ from state to state drastically. Even in your home state, it can be hard to be confident about what is legal and what isn't. At Have a Nice Day CBD, we are committed to providing legal CBD products. In this post, we are focusing on Oregon CBD Laws. Oregon is now the only state on the West Coast where you can buy CBD products without restriction. However, the laws are still more complicated than that.


Here is a breakdown the cannabidiol regulations: 

  1. Medical marijuana is legal for patients with a prescription.
  2. Marijuana and marijuana-derived CBD oil are legal if you are over 21 and buy from licensed dispensaries.
  3. Industrial hemp-derived CBD oil is legal for everyone. 


What is the difference between marijuana and industrial hemp?

Oregon CBD laws use the classifications marijuana and industrial hemp as a distinguishing factor in their regulations, but both come from the Cannabis Sativa plant and contain cannabinoids. Before we go into details about the Oregon CBD laws, we want to clarify the distinction. Industrial hemp is a variety of cannabis that includes less than 0.3% of the delta-9-tetrahydrocannabinol (THC). Hemp also contains greater than 20% cannabidiol (CBD).  Both cannabinoids provide benefits. THC has psychoactive properties, and CBD does not.  In 2018, the federal Farm Bill decriminalized industrial hemp, removing it from the controlled substances list and changing it to an agricultural product.  Marijuana is cannabis that has more than 0.3% THC. The higher level of CBD gives the user a "high" and is a very effective treatment for many conditions, especially around pain management. It also typically has less than 10% of CBD.


Is medical marijuana legal in Oregon?

Oregon was on the leading edge of the medical marijuana movement. It legalized marijuana for medical treatment in 1998, making it one of the first states in the country. To qualify for the Oregon Medical Marijuana Program (OMMP), patients need to have a medical condition that includes cancer, glaucoma, neurological conditions, HIV/AIDS, PTSD, and conditions that cause severe pain, muscle spasms, seizures, or severe nausea. Anxiety/depression and other psychological disorders that often respond well to marijuana are notably absent from the list of approved conditions. An out-of-state applicant needs to contact the OMMP to get an Oregon medical marijuana card. 


Is recreational marijuana legal in Oregon?

As of July 15th, 2015, recreational marijuana is legal in Oregon for those over 21. There are dispensaries licensed by the Oregon Liquor Control Commission, or residents can grow up to four plants at home. Because of how Oregon CBD laws distinguish between marijuana and industrial hemp, the recreational marijuana laws are key to understand before addressing CBD.


Is CBD oil legal in Oregon?

With the Farm Bill that decriminalized hemp, the federal law allows states to regulate CBD oil and CBD products. As you can see, state laws often complicate the law further.  The short answer is yes, CBD oil is legal in Oregon. Because recreational marijuana is legal in the state, Oregon CBD laws are relatively straightforward, but there are still some crucial elements to understand. As we mentioned earlier, Oregon breaks cannabis down by industrial hemp and marijuana. CBD oil and products made with industrial hemp cannabis that contains less than .3% THC, are legal to everyone. They can be sold everywhere, including even grocery stores, and, of course, online. However, if the product uses an inhalant delivery system, you must be 21 to purchase it and its components. There is CBD oil created by cannabis that contains more than 0.3% THC. Under Oregon CBD laws, these products fall under the recreational marijuana laws. They are still legal, but you have to be 21 to purchase them. Because of FDA rules, retailers cannot market CBD oil as a nutritional supplement, but that doesn't mean you can't still get health benefits!
