It’s All Legal…Right?

During the 20th century, the cultivation and possession of Cannabis were outlawed with the passing of the Marijuana Tax Act in 1937. In 2014, the enacting of the Farm Bill passed the responsibility of regulating the production of hemp on to individual states. This legislation, by association, also impacted the classification and legality of CBD. In 2018, an updated Farm Bill changed the legality of hemp a second time, federally legalizing its production.
Sounds easy, right? If only. While the 2018 iteration of the Farm Bill removed hemp from the list of controlled substances under the Drug Enforcement Administration and set the precedent that the plant can now be freely grown under federal law, there are stipulations. The most important one? While hemp is legal under federal law, the states are still responsible for creating policies surrounding its use.
Several states, including Alaska, California, Colorado, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, Washington, and Washington D.C., have legalized marijuana and CBD both recreationally and medicinally. In 23 other states, CBD and marijuana are partially legal, primarily when used medicinally and regulated by a physician. Another 14 states only permit the use of CBD oil, while Idaho, Nebraska, and South Dakota have outlawed the use of both CBD and marijuana regardless of classification.
Cannabis industry attorney Sarah Lee Gossett Parrish is quick to point out the almost-comical irony in the situation. "With marijuana, we have got the federal government saying 'No' and a bunch of states saying 'Yeah, it's OK'—but with hemp, the feds say 'Yeah, it's OK,' but we still have some states saying it's not."
