CBD in Washington

state of washington nature

Washington state is home to more than 7.4 million people, and luckily for those people, it’s also one of the friendliest states for legal marijuana and CBD usage. As a state, Washington legalized the recreational use of marijuana for adults over 21 in 2012, thanks to Initiative 502. However, the differentiation between CBD and marijuana did not occur until 2018 with the introduction of a law now commonly known as the “Farm Bill.”

In a nutshell, the Farm Bill recognizes that hemp and its byproducts (primarily CBD) differ from marijuana products and are legal for consumption without government regulation as a controlled substance.

What is CBD Oil?

CBD, also known as Cannabidiol, is an active compound present in the Cannabis plant. Different from marijuana (which contains more than 0.3% THC), CBD is nonpsychoactive. This means it has proven medical benefits but does not give users a high like marijuana products do.

CBD can then be made into CBD oil, once it has been extracted from the Cannabis plant and mixed with a carrier oil. Most commonly, CBD oil contains either hemp seed or coconut oil.

So, What Does CBD Oil Do Anyway?

Studies conducted in recent years have found that CBD can be useful in providing relief for quite a few conditions. These conditions include but are not limited to anxiety disorders, post-traumatic stress disorder (PTSD), chronic pain from illnesses like arthritis, and insomnia.

Although more research is still underway for other uses, a drug called Epidolex (with an active ingredient of CBD) was approved by the FDA in 2018. It’s currently being used to treat seizures in epileptic patients suffering from Lennox-Gastaut syndrome and Dravet syndrome.

The Hemp Versus Marijuana Debate

Hemp is a term that refers to a variety of Cannabis that contains less than 0.3% THC. Many believe that hemp was one of the first crops ever cultivated by humankind. Throughout history, hemp has been used for many things before CBD oil ever came into play. Did you know that hemp is also known as the strongest natural fiber in the world? In fact, hemp has over 50,000 uses for things like food, rope, clothing, and paper, to name just a few.

Marijuana, however, is a variety of Cannabis plant that contains more than 0.3% of THC, which is responsible for the euphoric high users feel. While hemp can contain no more than 0.3% of THC, marijuana can contain up to 30% THC.

Because CBD derived from hemp is not regulated as a controlled substance like marijuana, it is federally legal. Marijuana-derived CBD, however, is a bit of a tougher sell. Those products do remain under the regulation of the FDA as a controlled substance and are not legal everywhere. To ensure that you’re staying on the right side of the law, make sure you’re familiar with laws regarding both marijuana and CBD in Washington and always pay attention to where your CBD products are being sourced.

Now that we’ve gotten that out of the way, what are the policies surrounding CBD in Washington specifically? Let’s take a look!

CBD in Washington: Legal or Not?

Washington state is, in fact, a state where marijuana is entirely legal, so long as you’re 21 years old and abide by the purchase restrictions. However, you can only legally purchase marijuana at state-licensed retail stores.

Unlike marijuana, the sale of CBD in Washington is not regulated under state law. Because of this, legal requirements around the purchase of CBD in Washington have become more and more unclear in recent years. In September 2019, Washington’s Department of Agriculture clarified that CBD is not allowed as a food ingredient in products such as gummies, drinks, and other edible products. While edibles cannot legally contain CBD and be sold publicly, CBD topicals are legal.

However, the story doesn’t end there. You can still get your hands on CBD-infused edibles in recreational marijuana stores, where they are marketed as “marijuana products” instead.

So, What’s the Bottom Line Regarding CBD in Washington?

If you’re a new or long-time resident of Washington state, the good news is that Washington is a pretty lenient state in terms of the legality of CBD products. However, with all the new information coming out about CBD edibles, shopping for CBD in Washington might become a little trickier. The safest bet is to stick to what you know is legal for purchase without consequence, which is CBD oils, tinctures, lotions, and other non-food items.

But Wait, Can’t I Legally Buy CBD Oil Online?

Yes! It is legal to purchase CBD oil products online so long as it complies with a few guidelines:

  1. It must be sourced from industrial hemp.
