In May of 2019, President Trump signed off on the Agricultural Improvement Act of 2018, more commonly known as the Farm Bill. The 2018 Farm Bill recognizes hemp as a legal agricultural product for the first time. With the passing of this bill, hemp and hemp-derived products have been removed from the Controlled Substances Act, which formally categorized CBD and other hemp-derived products as a Schedule 1 Drug.
CBD and associated hemp products are no longer categorized as a Schedule 1 Drug, although marijuana still is. As long as the CBD extracted from the hemp plant is entirely pure, with less than .03% of THC, and is grown in accordance with federal and state regulations, it is considered a legal product.
The FDA does have the authority to regulate CBD and hemp-derived products, so it’s important to keep up to date on their guidelines and regulations.
Does That Mean CBD is Legal in Florida?
This is where things get a little more complicated. State and federal laws can vary and contradict each other. A perfect example of this is marijuana laws. Federally, marijuana is still classified as a Schedule 1 Drug. While numerous states have made the use of medical marijuana legal over the years, according to the federal government Schedule 1 Drugs have no accepted medical treatment use in the U.S. Additionally, over the past few years more and more states have voted to legalize marijuana altogether.
